And when there is broad societal consensus about what children need—such

as education and health care—the state properly preempts parental authority,

requiring all parents to send their children to school and to obtain necessary

medical care.6 But in many other instances, especially where there is no

societal consensus, the law properly defers to parental judgments, at least for

young children.7 (As we explain in this Essay, adolescents do and should

have more autonomy over some matters.)8 This deference to parents is

especially important for marginalized families because the judgments of

other parties may reflect bias and dominant parenting norms.9

Some scholars contend that to promote children’s interests, the legal

system should limit—rather than reinforce—parental rights.10 We share

these scholars’ commitment to the goal of promoting child and family

wellbeing, but we are concerned about their proposed means. Perhaps most

critically, these scholars underestimate the risk of displacing parental

judgment. Given the inability of young children to make consequential

decisions for themselves, the law can either defer to a parent’s decision or

substitute parental judgment with that of judges, social workers, and other

government actors who are strangers to the child.11 There is no reason to

believe these actors are better positioned to make decisions, and the process

of supplanting the parent can inflict harm on the parent-child relationship.

Alternatively, these scholars argue, the state could expand the role of third

parties in some circumstances. Third parties may know the child better than

government actors, but the process of enforcing third parties’ judgments over

the decisions of parents can also inflict harm on the child and still requires

government actors, such as judges, to determine who is better positioned to

make decisions for the child. In short, in our view, weakening parental rights

would create substantial disruption in families and harm children, especially

Santiago was not only criticized by Manolin's parents who considered him 'Salao', the worst form of unlucky, but by most other fishermen as well. In the novel, Heminway describes a time when the old man and the boy sat together on a terrace. The other fisherman began to make fun of him and those who didn't simply turned a blind eye. When Santiago had gone eighty-four days without catching a fish people were sure he was an unsuccessful fisherman. Although everyone around him either laughed at or pitied him he was always composed. The boy he practically raised and taught to fish was forced to leave him because people believed Santiago was unfit to fish with the boy. Everyone looked down on him and he was still optimistic and strived to do better, not because his community disregarded him but for himself. The constant talk of his misfortunes did not matter to Santiago and he paid no mind to them. Everything Santiago did was to achieve his own goals not to change anyone's opinion of him because he knew who he was and that was all that mattered.

Santiago suffered judgment from many and was still never disheartened. His spirit never faltered from the disapproval of others but it also did not waver while he endured extreme physical stress. After eight-four days gone without catching a fish Santiago decided to go farther out into the sea. He caught onto one of the biggest fishes he had ever seen. After dealing with such adversity, he decided that he would not go home without that fish. The fish dragged him farther out to see, causing the tension in the line so slowly and continuously dig into his skin. He went two days and two nights stuck in the beating sun and cold night while trying to capture the fish. Once he eventually caught the fish his travel back to land was far worse. The bloody fish attracted sharks that were just as persistent as Santiago. They began to bite chunks out of Santiago's great catch, drawing in more sharks. By the end of his journey the sharks had eaten the entire fish, broke a number of his equipment, and physically and emotionally drained him. Even though Santiago had success within reach and got it ripped away from him he was not resentful. When he got back he focused on the positive side of things and the fact that he missed not being alone instead of his failure. He did not feel the need to explain himself to everyone or to boast about the great fish he lost. He accepted what happened and moved on without complaint.

Throughout the period Heminway described in his book, Santiago's life was full of bad luck and disapproval but he somehow managed to come out emotionally unscathed after every misfortunate event. In Heminway's book he details many tragic events that took place in Santiago's life but portrays his resilience to such things and ability to come back from anything. Ernest Heminway can be known for including hidden meanings and allegories in his writing. In the Old Man and the Sea, Heminway indirectly conveys the meaning of a man living a life of adversity and finding peace within himself.
